Qu’il s’agisse de terrain à bâtir ou de terre à cultiver, le défi pour de nombreux pays africains est de taille : Comment peuvent-ils sécuriser la propriété privée ?
Le système foncier en Afrique continue à pénaliser lourdement la modernisation de l'agriculture, et pose des questions de justice sociale, de dualité entre normes juridiques modernes et traditionnelles, mais aussi d’investissement auprès des institutions financières – qui redoutent le phénomène de spoliation des terres et l'expropriation sans compensation adéquate. C’est en particulier le cas des espaces ruraux, où la structure de la famille élargie, couplée à des systèmes d'héritage variés et complexe, rend la transmission de terres agricoles encore plus difficile.
